Evgeny

Evgeny helps international clients navigate the complexities of the U.S. legal system. In the litigation context, he advises clients on pre-litigation options for resolving disputes, helps formulate a litigation strategy, and thoroughly litigates cases. In Evgeny’s corporate practice, he advises startups and investors on fundraising, corporate governance, sanctions compliance, and intellectual property protection. He also manages the trademark registration process on the Skala platform.

Evgeny explains complicated legal issues to clients in plain terms and gives them an honest take on the opportunities, risks, and costs involved in each course of action they are considering.

While away from the law, Evgeny goes on walks with his family, practices calisthenics, plays music, and travels.

  • Tenzor Capital Ltd. v. Riveted Games, LLC, and Devine (DSC 2024)
    Represented plaintiff, a cryptocurrency venture capital fund, in lawsuit seeking the return of funds invested through a SAFT in game developer that failed to implement the project and embezzled the proceeds. The court awarded the plaintiff $1.4 million in damages.
  • Sarafan Mobile Ltd. v. Google LLC and Meta Platforms, Inc. (ND Cal. 2024)
    Represented mobile app developer in a case challenging the removal of their app from Google Play following a trademark infringement complaint filed by Meta. Secured the app's reinstatement under a comprehensive settlement agreement following a motion for a temporary injunction.

  • Goeated Ltd. v. Barlow et al. (EDPA 2022)
    Represented plaintiff company in breach of contract action to recover $1.3 million in crypto funds.
  • Khundzhua v. Kulik and RPV Capital LLC (Del. Ch. 2024)
    Represented plaintiff in a dispute with the co-founder of a venture capital fund with the aim of expelling the defendant-co-founder from the fund and invalidating all actions he had taken since his exclusion.
  • Sammy’s Warehouse v. Cecilia Tech, Inc., et al. (JAMS 2024)
    Represented one of the defendants in an arbitration dispute, where the plaintiff alleged a breach of a non-disclosure agreement and a refusal to act in defiance of the counterparty. As a result of an effective defense strategy, the plaintiff withdrew the claim against our client.
  • Leading Russian law firm
    Prepared legal opinion and provided expert testimony on the application of U.S. sanctions legislation to dispute between major industrial enterprises before international commercial arbitration tribunal.
  • Leading Russian media holding company
    Developed strategy and prepared legal opinion to restore an app developer's account in the App Store and Google Play.
  • Linked Helper LLC v. Waapi SAS et al. (NY Sup. Ct. 2022)
    Secured default judgment and attorney's fees award for plaintiff in unfair competition action, as well as enforcement of the judgment and compensation from the defendant in France.
  • BEEQB LLC v. Blockquarry Corp. and Pantheon Resources, Inc. (DSC 2024)
    Represented crypto mining company in case regarding the illegal seizure and use of its equipment worth several million dollars. Secured return of most of the equipment to the client.
  • Meshcheriakov v. Citibank, N.A. et al. (NY Sup. Ct. 2022)
    Represented plaintiff in action to recover frozen funds from correspondent bank.
  • Morozov et al. v. U.S. Health Mgmt. Inc. et al. (NY Sup. Ct. 2021)
    Represented defendants-counterclaimants in a breach of contract action. Successfully opposed plaintiffs’ motion to dismiss.
  • uFaktory Oy v. The Black Fives Foundation (TTAB 2020)
    Represented petitioner in trademark cancellation action and coordinated strategy in several other jurisdictions in related disputes involving the same parties. Successfully defended against respondents’ motion to compel discovery.
  • Abbott Laboratories et al. v. Adelphia Supply USA et al. (EDNY 2018)
    Represented several defendants in international trademark dispute over diabetes test strips. Participated in successful effort to dismiss several claims and deny plaintiffs summary judgment on damages. 
  • Tooker et al. v. Whitworth et al. (NY Sup. Ct. 2018)
    Represented the defendants, successfully dismissing most of the claims and dismissing the claims against one of the defendants. Obtained favorable settlement.
